1. I have a family lawyer. Is he/she qualified to handle my personal injury case?

Legal intricacies are just as complicated as the nitty gritty aspects of medical care. Personal injury cases carry with them the weight of urgency as claimants suffer physical injuries as well as mental scarring. Frequently there is resulting loss of pay and emergency room charges to contend with. Under such circumstances it is best to entrust Personal Injury cases to practicing, veteran Personal Injury lawyers who not only know the laws, but also have a pool of precedents to draw upon for successful representation.

2. My insurance company says I do not need a lawyer. Is this true?

Definitely not. First, your insurance providers are not empowered to dispense legal advice and thus their recommendations are not fool-proof. Second, as discussed in the previous question, personal injury cases are quite complicated and require specialized knowledge which only practicing lawyers possess. And last but definitely not the least, it is important to keep in mind the fact that your interest may not be the priority of the insurance provider who is, after all, in a business and looking to turn profits.

3. When should I ideally contact a personal injury lawyer?

As soon as the accident/mishap happens. In all US states, there is a statute of limitation – a pre-defined time period over which the claim has to be filed. Failing to do so can lead to the victim losing the eligibility to sue.

4. What do I need to bring when meeting my personal injury lawyer for the first time?

The first meeting or consultation is critical because it sets the tone for the client-lawyer relationship and offers your personal injury attorney the chance to evaluate your case without being involved. This generally removes biases and helps him/her estimate the claim amount. You, as the victim, should be armed with:

  • A detailed account of the mishap and a history of mental and physical depredations suffered since the actual accident.
  • A log of all medical and therapy bills
  • The doctor’s formal diagnosis and the specifics of any long term impact (loss of mobility, loss of vision and so on)
  • Any other items/documents you think are related to the accident

5. What is the value of my claim?

It is difficult to analyze and give an accurate estimation of the claim value of a Personal Injury case. In general, the value depends upon:

  • Medical bills paid and estimated medical care required in the future
  • Physical and mental pain and suffering
  • Lost wages and loss of earning capacity
  • The severity of the injuries
  • The negligence of the defendant
  • The identity of the defendant

We elaborate on these contributing factors in our carefully prepared report ‘What is Your Personal Injury Claim Worth?’ You can download it here

6. How much time do I need to spend on my case?

It depends on the complications of your personal injury case. Typically after commissioning the services of an attorney, you need to update him/her regarding the progress of your recovery. The victim may also need to participate in discovery, gather evidence and answer questions to fasten the settlement process. The simplest Personal Injury cases are solved in a few weeks. The more complicated ones may stretch on for years.

7. What is negligence?

Negligence is usually the mainstay of a Personal Injury case. Simply put it refers to dereliction of reasonable duty on part of the defendant. You are eligible for financial recompense if and only if the mishap or accident is the result of ‘negligence’ of care by the other party.

8. What is a deposition?

A deposition is the oral statement of a witness taken under oath before the trial commences. It proves useful in cases in which the testimony of the witness can compel parties to reach an out of court settlement.

9. I slipped and fell on someone’s property. Am I eligible to seek Personal Injury redressal?

If you slip and fall or injure yourself in any way under dangerous conditions on someone else’s property then you can seek damages from the person(s) concerned. The qualifying factor here is usually negligence on part of the landlord or owner. Do consult with an experienced Personal Injury attorney to evaluate the conditions of your case and to ensure justice.

10. I was injured on the job, what kind of damages can I claim?

Being injured at work is a very common issue. About 3 million Americans suffer from injuries every year because of personal or employer negligence. Please download our free report ‘Workplace Accidents: Damages you can Claim’ here to study this in more detail.
